Terms of service.
The rules for using Crashmates. By creating an account, you agree to these terms. Last updated 2026-06-09.
1. Acceptance of terms
These Terms of Service (the “Terms”) govern your access to and use of Crashmates (the “Service”), operated by Crashmates, Inc. (“we”, “us”, “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you don’t agree, don’t use the Service.
2. Eligibility
To use the Service you must:
- Be at least 18 years old.
- Be a current student at an accredited US college or university listed in the federal IPEDS database.
- Have a valid .edu email address issued by your school.
- Not be barred from using the Service under applicable law or under previous Terms violations.
- Not be located in a country embargoed by the United States government.
If we determine you don’t meet eligibility, we can suspend or terminate your account at any time without refund.
3. Your account
You’re responsible for: (a) maintaining the confidentiality of your login, (b) all activity that happens under your account, (c) keeping your email and profile information accurate, (d) immediately notifying us at support@crashmates.com of any unauthorized use.
One person, one account. Don’t share your account. Don’t transfer it. Don’t create multiple accounts. We reserve the right to suspend accounts that violate this.
4. Credits and payments
Crashmates uses a credit system. You can buy credits in packages (currently 10 / 25 / 50). One credit unlocks sending the first message in a new conversation. Receiving messages, browsing, and matching are free.
Credits never expire. Once purchased, credits remain in your account until used or until your account is terminated.
Refunds. Unused credits are refundable within 30 days of purchase. Used credits are non-refundable except where required by applicable consumer protection law. To request a refund email support@crashmates.com from your registered .edu address.
No subscriptions. Credits do not auto-renew. You only pay when you choose to buy more.
All prices are in US Dollars. We use Stripe as our payment processor and do not store your card details on our servers.
5. User content
You retain ownership of content you post (profile text, photos, listings, messages). By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, distribute, and modify your content as needed to operate the Service.
You’re responsible for your content. Don’t post anything illegal, infringing, defamatory, or that violates these Terms. We can remove content that violates these Terms at our discretion and without notice.
We don’t pre-screen content but reserve the right to review and remove it. We aren’t responsible for content posted by other users.
6. Acceptable use
You will not:
- Harass, threaten, stalk, or abuse other users.
- Post sexual content, nudity, or content sexualizing minors.
- Solicit money outside the Service’s credit system.
- Scrape, crawl, reverse-engineer, or copy data from the Service.
- Use the Service to send spam, marketing, or commercial offers without our prior written consent.
- Impersonate another person or misrepresent your school affiliation.
- Circumvent verification, ban, block, or rate-limiting systems.
- Use bots, scripts, or automated tools to access the Service.
- Use the Service for any unlawful purpose.
7. Fair housing & non-discrimination
The federal Fair Housing Act and many state and local laws prohibit discrimination in housing based on race, color, national origin, religion, sex, familial status, or disability. Some roommate-selection contexts have limited FHA exceptions — but Crashmates enforces non-discrimination as platform policy regardless.
You will not post profiles, listings, or messages that express discriminatory preferences based on protected characteristics. You will not refuse to communicate with or reject matches solely based on protected characteristics.
Confirmed discrimination violations result in immediate account suspension and may be referred to HUD or relevant authorities.
8. Intellectual property
The Service — including all software, design, branding, copy, and assets that aren’t user-generated — is owned by Crashmates, Inc. and protected by US and international copyright, trademark, and other IP laws. You don’t get a license to copy, modify, distribute, or create derivative works from any of it.
DMCA. If you believe content on the Service infringes your copyright, send a takedown notice to legal@crashmates.com with: (a) your contact info, (b) identification of the work allegedly infringed, (c) the URL of the infringing material, (d) a good-faith statement that the use isn’t authorized, (e) a statement under penalty of perjury that the information is accurate and you’re the rights holder or authorized agent, (f) your physical or electronic signature.
9. Termination
You can delete your account at any time from your settings or by emailing support@crashmates.com.
We can suspend or terminate your account at any time, with or without notice, for any reason — including violation of these Terms, suspected fraud, abuse, or extended inactivity. Upon termination: your profile is removed, your messages may be retained for safety/legal reasons, and unused credits may be refunded at our discretion (subject to applicable law).
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. We don’t warrant that: the Service will be uninterrupted or error-free, profiles or listings are accurate, compatibility scores will result in good matches, your interactions with other users will be safe or satisfactory.
Crashmates is a platform that helps you find other verified students. We are not a party to any rental agreement, lease, or arrangement between users. We do not screen tenants, run background checks, or guarantee any user’s identity beyond .edu verification.
11. Limitation of liability
TO THE MAXIMUM EXTENT ALLOWED BY LAW: CRASHMATES, INC. IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL — ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (a) US $100, OR (b) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions don’t allow these limitations — if you’re in one of them, this section applies to the maximum extent permitted.
12. Indemnification
You agree to defend, indemnify, and hold harmless Crashmates, Inc. and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from: your use of the Service, your content, your violation of these Terms, your violation of any rights of a third party, or your violation of any law.
13. Dispute resolution & arbitration
Informal resolution first. Before filing any formal claim, contact legal@crashmates.com. We’ll try to resolve in good faith within 60 days.
Binding arbitration. If informal resolution fails, any dispute will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in Los Angeles, California. The arbitrator’s decision is final and enforceable in any court of competent jurisdiction.
Class action waiver. You and Crashmates, Inc. agree that disputes will be brought in your individual capacity only — not as a plaintiff or class member in any class or representative proceeding.
Exceptions. Either party may bring an individual action in small-claims court, and either party may seek injunctive relief in court for intellectual-property violations.
Opt-out. You can opt out of the arbitration clause by emailing legal@crashmates.com within 30 days of first accepting these Terms.
14. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Where arbitration doesn’t apply, you and Crashmates, Inc. consent to the exclusive jurisdiction of courts in Los Angeles, California.
15. Changes to these terms
We can update these Terms at any time. If we make material changes, we’ll notify you by email and/or in-app notice at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms. If you don’t accept, stop using the Service and delete your account.
